(1) Section 29N of the Ministry of Foreign Affairs Act. An updated list containing the names, addresses and other related details of the persons, groups or organizations listed in accordance with the above shall be prepared and immediately provided to the Ministry.
(2) As soon as the ministry receives the updated list according to sub-rule (1), it shall immediately issue an order to freeze the property or funds of the person, group or organization in the list and publish the notice on its website for the information of all concerned.
(3) Section 29f of the Act. According to sub-section (1) of the Ministry of Foreign Affairs, if a request is received from a foreign country to freeze the assets or funds of any person, group or organization, the Ministry shall investigate the following matters:-
(a) Whether or not the request has been made in accordance with the law of the respective country,
(b) Whether or not there is a factual basis that any such person, group or organization or its assets or funds are or may be in Nepal,
(c) Whether such request is in accordance with the prevailing laws of Nepal or not (d) whether or not the person, group or organization concerned with the property or funds sought to be withheld through such request is in Nepal, or (e) Whether or not the assets or funds of such person, group or organization are or are likely to be in Nepal.
(4) The Ministry shall complete the investigation as per sub-rule (3) within three days at most from the date of receipt of such request.
(5) The Ministry itself may issue any person, group or organization in Nepal or abroad under Section 29f of the Act. According to sub-section (3) of the following matters should be investigated if the action to be listed in the list of invasive persons, groups or organizations has to be carried forward:-
(a) According to the Act or prevailing law, there is a mental basis that an act of aggression will or may occur, or that financial investment has been made or may be made in an act of aggression,
(b) Any other person, group or organization who is associated with the person, group or organization that acts as per Clause (a) or has a mental basis to be associated with it.
(6) Sub-rule (3) or(5) If it is found that any such person, group or organization is or may be an invasive person or group or organization during the investigation, Section 29f of the Act. In accordance with sub-section (3) of the Act, it shall be submitted to the Government of Nepal, the Council of Ministers to be listed in the list of aggressive persons or groups or organizations and to issue an order to freeze the assets or funds of such persons, groups or organizations.
(7) Pursuant to sub-rule (6), if the Government of Nepal, the Council of Ministers lists any such person, group or organization as an aggressive person or group or organization and issues an order to withhold property or funds, the ministry shall immediately publish it on its website in the format as per Schedule-1.
